- The title of this post is borrowed from a book written by Shahnon Ahmad. The phrase refers to the challenges that a man goes through in his life. I grew up in a life full of challenge with very little helping hand from those who can helped. I know how hard life is and for that reason I wowed that whenever and where I can help anyone I will help. My challenge with the issues of abandon housing has been extremely painful. We are battling the developers who couldn’t care less.
- Far worse when we have to fight our way to get the government department to lift a finger. In the last 3 years, we have to constantly engaged MHLG and they seem to move when we raised our voice or simply threatened them by escalating the issue to other agencies or the KSN himself. One would expect the MHLG to act in the favor of the people but unfortunately they did not. In the last 72 hours, I have had very little sleep after the developer of Ukay Bistari decided to windup the company using a friendly party. Construction is at 85% to 100% stage and everything stops in the last 3 days. There is a total silence on site and one can hear a pin drop.
- We had anticipated the move by the developer as early as 3 years ago when we started this crusade. We even told MHLG that there is a shortfall of RM12 mill and the developer must pumped in the money first before they expect the money to be drawn from the purchasers. MHLG wanted to try their approach and we gave into the Minister request to let him try his way. The minister told us that TSCAC has given his word that he will complete the project and cover the shortfall. Today all that is shattered. Many of us owed the banks at 40%-50% of the house previously now owns the banks at 80%-90%. Many have been made poorer. In the last 3 days I have become a zombie. I met so many people in trying to get help. I drove all over Klang Valley to meet people that I think can help. I asked everyone that I had helped in my life to return the favor if they can. It is not for me but for 1300 families. They are about to lose everything! I don’t know what else to do and at the point of writing I am on the verge of breaking down. I have failed! I have failed! I have failed the 1300 families that depended on me. Ya Allah, please help this 1300 families. I beg YOU.


Sorry doc. Thought that a political pseudo committee overriding the mb and Exco decision has put us a few steps back in democratic governance. this is all wrong. And to admit that a revolt against mb was due to contractual award not going to pr companies just smack of utter cronyism. We’re not moving forward at all. Seperti kata saya impact nya sangat besar. Kos kita boleh panggil buyer2 untuk bersama2 tanggung. Pembeli mungkin tiada pilihan lagi.

I agree with you and feel there is a basis on why the government is accountable. The simplest basis is that they created a law that is biased against house buyers
Sorry. Think it’s the wrong cause of law. You cannot sue the parliament. Must distinguish the executive which is often referred to as the government and the people represented by the parliament. The remedy lies in law and people. Both bn n pr must put a similar stand on this. Every rep must be made accountable.
I still think the way forward is to follow Ana’s zubedy way. You guys have a strong lobby ie the votes. Commit the rep in writing or camera on the way forward to amend the law. Use the tender model going forward. You may condemn the MHLG but pr makes no promise either. We as people must get out reps to work for us and our votes. Use this as an election tool but put it on record and push it at you tubes etc. best of luck.
I don’t believe anyone here can effectively help once TSCAC and his companies decide to abandon a project. I will explain why later in my comments. The only party that can help, if they want to, is the regulating authority for housing developers, namely the Ministry of Housing and Local Government (MHLG). Why MHLG won’t and don’t help, we can only speculate.
I suggest that it will be better to utilise energy and resources into preventing future victims by cautioning and warning ignorant potential future house buyers against buying properties from any company connected with TSCAC, including any future companies using new and different names. Whoever buys and takes over TSCAC’s companies should also be held accountable for completion of TSCAC’s abandoned projects. This can be done by publicising all the failed projects, abandoned projects, projects completed after long delays and projects completed but with serious construction defects. I believe majority Malaysians tend to be ignorant of TSCAC until they buy his houses and either get a house completed with multiple serious defects, or a house completed many years after the agreed legal completion date, or a combination of both, or worse, never get delivery of their houses when the project gets abandoned.
No doubt legal advice will need be sought so that such publication will not run foul of the law, including those pertaining to libel.
Many few years back, I attended a meeting called by Selangor PTG in relation to applications for strata titles that could not be given final approval because of inaction by the respective developers. Those attending the meeting were developers’ representative, developers’ consultants and house buyers representatives. Included in the meeting agenda were about 15 applications which had received provisional approvals, with the final approval pending either because they were awaiting payment of certain statutory fees or compliance by the applicants (developers) of some minor conditions. The first thing I noticed at the meeting was that there were so few people attending the meeting when about 15 developments were involved. After the meeting started, the reason for the lack of attendees became apparent. Majority the problem applications were from ONE single developer, namely TSCAC’s companies and were represented by ONE single gentleman.
The main reason why many of the TSCAC projects could not be given final approval was failure to pay small amounts of statutory fees. For one particular project that I still remember after so many years, the amount of fees due but not paid by the TSCAC company was a mere few thousand ringgit. When asked by the chairman for the reason for failure to make payment after over a year, the TSCAC representative very coolly and unashamedly answered that his company did not have the few thousand ringgit to pay the fees. When pressed by the chairman, the representative insisted that there was no way his company will be able to come up with the few thousand ringgit. There was unashamed nonchalance in his reply. Simply and crudely put, TSCAC’s company couldn’t care a fxxx if their buyers never get their strata titles.
The buyers’ representative then stood up and informed the chairman that she had been authorised by all the buyers to pay the few thousand ringgit on behalf of the TSCAC company on condition that the PTG put on record an official commitment that once the payment was made by the house buyers, the final approval will be given expeditiously and that strata titles will be issued without any more undue delay. The TSCAC representative unashamedly agreed that his company will not object to the buyers paying the fees which actually was the legal responsibility of his company. The practical minded and smart buyers must have worked out that each of the few hundred buyers need only pay about RM10 each to settle the long outstanding matter.
The above case shows that TSCAC was prepared to abandon the strata title application because of either refusal or inability to pay a few thousand ringgit. What hope is there for buyers when their houses are not even completed and his company may have to spend millions to complete the houses?

This is what we people always long for build and sell concept. That’s the only way of getting rid of greedy housing developers. These days, me too can become a housing developer if I can secure a 99 years lease on a parcel of land. The rest of capital will come via syndicated bank loans guaranteed by borrowers mortgage. This business model works best for greed of bankers.

After carefully assessing the situation, the farmer sympathized with the mule, but decided that neither the mul…e nor the well was worth the trouble of saving. Instead, he called his neighbors together and told them what had happened…and enlisted them to help haul dirt to bury the old mule in the well and put him out of his misery. Initially, the old mule was hysterical! But as the farmer and his neighbors continued shoveling and the dirt hit his back. It suddenly dawned on the mule that every time a shovel load of dirt landed on his back…he should shake it off and step up! This he did, blow after blow. “Shake it off and step up…shake it off and step up…shake it off and step up!” he repeated to encourage himself. No matter how painful the blows, or distressing the situation seemed the old mule fought “panic” and just kept right on shaking it off and stepping up! It wasn’t long before the old mule, battered and exhausted, stepped triumphantly over the wall of the well. What seemed like it would bury him, actually blessed him…all because of the manner in which he handled his adversity. That’s life! If we face our problems and respond to them positively, and refuse to give in to panic, bitterness, or self-pity…the adversities that come along to bury us usually have within them the potential to benefit & bless us .

The act of helping others who are in trouble, is a noble one. It does not mean we succeed every time, although that is what we aim for. Take a breather if you need. Rest and recover… and resume the struggle, if you have the energy to fight on. But if you don’t, I wouldn’t think the affected housebuyers would fault you for the effort you have put in.

Speaking for myself, I will remember who has been screwing us all this while and not forget who has’nt. Dont mean to rub you the wrong way but I am equally as angry as I have also been a victim of an abandoned project. The reality is that house-buyers are totally at the mercy of unscrupulous developers and the FG has not shown any resolve to rectify the situation through legislation. I will support whichever political platform that advocates and implements Build-then-Sell legislature.

I hope at this depress moment, you know whom is the root of the problem. Abandon housing is one of the many policies that does not look after the buyer’s interest.
In Malaysia, we have been suppress with a lot of matters. People migrate because of frustration of the government not looking after the people’s interest.

What had has happened, the root cause is from Barisan Nasional. They cease to be wakil rakyat, they only wakil poket sendiri.
The policies from FG that kills the rakyat, the lopsided policies. When things fails who is accountable and who is responsible. Seems now only the victims has to pay for it and the rest is laughing to the bank.
We need to bankrupt some developers and put some in jail too. Thereafter we need to hang some politicians whom wakil poket sendiri.

Please continue the fight and don’t feel depress. I know an individual that have been helping the poor for so many years. Though he face a lot of challenges yet he never give up. He believe that good will prevail. He once told me sometimes you can only do your best to help and don’t feel depress if things didn’t work out as plan. He said every now and then he failed on helping people. But he said there are too many people that need our help; thus, we must not feel depress. Feeling negative or depress will never help these people. I am a nobody … but I promise you’ll I’ll pray for you and the victims. Also, if you want to stage a demonstration just let me know the time and date …. If possible please plan it around 1st week of April that’s the only time I am available.

They are now focussing in the highway (robbery) project, in milking the country and people, billions to be shared with those in the corridors of power.
