After seeing the massive landslide that affects us in BA, the subject of hillside development has become my obsession. I have become more sensitive to the environment that I lived in and observed every single little clue that point to the presence of some risk. I get agitated on many occasions because I find the NGO’s and authorities are slow in their actions. On occasions my approach is frontal and brutal. What interest me is that what to be done needs should be done.

I believe it was in April 2009, I attended the very first session on public briefing by the Selangor State Government (SSG) held at the SUK which was chaired by the MB. The director of JPBD, Dato Jaafar talks at length about new guidelines in slope developments where it is design to create a safer living environment. The event was attended by developers, state officers, REHDA and state Exeo’s and MP’s.

In that meeting, I spoke at length about the concern of the people in the street. Among others I mentioned about the public distrust of the government and government machinery like MPAJ. I raised the issue where officers can manipulate the system.

Ronnie Liu misunderstood me at that time and asked me which government I was referring to and I told him I was referring to both and the government machinery. Dr Xavier defended the argument that I had raised. I was assured that with new guidelines all loopholes will be addressed. This is the promise given to me by the MB and Dato Jaafar. In my heart, I whispered; Yeah! Right!

In early 2010, after the completion of the BA mosque the “Mosque Development Committee” (MDC) which has more than RM1.8 mill in their coffers toy with the idea of building 10 units of houses within the tight mosque compound. The money was collected over the years via donation solicited from the public, residents and fun raising activities with the publicity that it is to be used to build the BA mosque. Two years ago the construction of the mosque was completed with funding from JAIS and not a single cent of the money in this coffer went into the construction of the mosque.

In March 2010, MPAJ puts up an empty signage at the entrance of the mosque where it is seeking a public opinion from neighboring plots. The board carries no dates or file reference numbers. The signage was empty for months. Two days ago, I saw the board was filled with reference number of the applicant and the closing date of any objection was set to be at 17/8/2010.

Yesterday, I called MPAJ and I was informed that the application has been approved on 20/7/2010. It is amazing how efficient MPAJ can be when it can approve an application within days after the closing date of any objections and they take a month to reply a simple letter. I checked around with several surrounding neighbors and no one had received any notices from MPAJ.

It really pisses me off. This is a case where it again proves that MPAJ cannot be trusted in their ability to carry a professional job in a just manner. This is exactly opposite what the MB and Dato Jaafar promised me. In this one instances alone, a public consultation process was deliberately sidelined. At least several procedures and guidelines was NOT ADHERED to. This includes zoning laws 2008, JPBD guidelines on slope developments and JPBD guidelines on residential development.

Now an approval has been given to the construction of 10 unit houses in a Class III area and which is located less than 20 feet from a Class III and Class IV slope. The land area is zoned for public facilities. The land space itself is inadequate to meet the current usage and yet they want to put up 10 units of houses. In the last two days, I have gone on a frontal assault with MPAJ and raising hell at LPHS, JPBD and MB office. I promised this will not be the end. I will fight till the end. What is wrong cannot be allowed. Resident safety is paramount. I will not allow a group of people who wants to spent RM1.8 mill to put people’s safety at risk.
While this is going on, the very people that runs an NGO that claims to be the champion and custodian of hill slope safety has chosen to be silent. An active PKR group in BA and the local council member has also been quiet. Both appear to be protecting their rice bowl as well as the political impact. Both do not want to put a stand on the matter even though MPAJ is wrong. Why is that usually they would paste a pictorial activity in residents yahoo groups to publicize their response when a tree fell or even go and see a hole in the middle of the night but was very silent on this matter?
Maybe they just do not want to offend MPAJ and the MBA committee to ensure that they will continue to profit from contracts from MPAJ. Maybe because it is a request from a mosque, they don’t want to appear as a bad guy by challenging the approval given by MPAJ. Maybe it is a politically sensitive area. Personally, I feel this people have betrayed the people of BA and should not hold office. There is a clear conflict of interest here. People with personal interest should never be allowed to look after community interest. I was told that even COBARA office bearers have not reacted adequately.

When was this details filled? Was it after approval was given ? How is it none of the bordering residents knows about this?

Kerajaan Selangor, MPAJ dan pihak pengurusan Masjid patut memberikan penjelasan pasal isu ini. Jangan salah faham, saya bukannya membantah penubuhan masjid.
Tiada isu yang lebih penting ialah keselamatan penduduk sekitarnya. Telah terlalu banyak kes tanah runtuh dan kehilangan nyawa disekitar BA.
Kita semua tahu, walaupun ada peraturan tapi siapakah yang benar-benar memastikan peraturan itu dilaksanakan tanpa komproni?
Kes-kes sebelum ini, puncanya disabitkan kepada bencana alam (kononnya act of God!) tapi sebenarnya punca adalah niat manusia yang tidak peduli pasal keselamatan orang lain.

1-As you mentioned, its amazing when MPAJ was quick to proceed once objection date was over and yet took weeks to respond to a single letter
2-May I know those 10 units are for what purposed? Are they for the Masjid’s staff ie. imam etc?
3-The place I stay nearby Kemensah, has this piece of land nearby which is say is not that big but already proposal letters have been sent out saying 20+ units of house will be built. They sure are good in squeezing new development at very limited and sloppy grounds!
4-Pls continue to raise this issue with the MPAJ, MBs office, Azmin’s office and what not

The mosque committee said it will be used for
(1) Some units for mosque staff
(2) Some units will be rented out for income
(3) One unit will be made like hostel for visiting guest
My contention has always been (a) Why built when it is cheaper to buy in view of cheap condo prices in BA. No one wants them. Many vacant units. The condo is located 100m from mosque entrance (b) If the existing condo is BA has 40%-60% occupancy, what made they think they can rent out their units. Which tenant would want to live in an apartment where there is no bus service. (c) If it is for income, there are many other ways of spending 1.8 mill that will bring continous income for the mosque. For eg Buy shoplots. That will easily give a 6-7% rental income.
Doc, welcome to the real world of our Local Authorities. I have been in the Engineering Profession for 36 years and believe me I still have not seen everything yet. Because I choose not to play ball with them, invariably, quite a few of my projects get delayed, unless I know the head of department personally, or my Clients do the running themselves.
I was hopeful that with the change of the State Government things will improve, but with the Local Councillors not being elected, they can’t do very much and the “Little Napoleans” in the local authorities are still calling the shots. Unless the State Government is able to bring “their people” to head the local Authorities I am afraid not much will change as the “Mayors/Presidents” are still beholden to the Federal Government and the culture is too entrenched. Yes, all these ties back to the Federal Government!
Please continue to agitate for change in all levels of the public service…….this Country cannot continue going in this direction……………..towards the failed nations of Africa!
Your dogged persistence in this issue is highly commendable. Not sure what I can offer. But if you wish to start coalition against any development at Bukit antarabangsa hills I can support you. Better still if you push this issue towards a more tranparent and widen application of public participation, you have my wholehearted support. Any development of the Bukit antarabangsa hill can affect the whole residents of Bukit antarabangsa. Why not expand those who stay in BA can object to it also. Give prominent notice to all and not merely neighbours. And allow Them to object by various means including Internet. Also have specific guidelines which is stringent making it expensive to develop BA on a large scale.

(1) I am not against development in BA in total. There are areas which can be developed provided they follow the rules. Plenty of flat land here.
(2) I am upset because there is no transparency and due process is disregard
(3) In the dialog with JPBD I asked for public participation (especially neighboring plots) in decision making. This was rejected
(4) I am very angry at the moment. I am angry at (a) PKR BA (b) Ahli Majlis PKR (c) Slope watch committee which seems to have a confilict of interest (d) At COBARA committee members who are slow in reacting (d) At MPAJ for not being neutral and following laws.
Just because the application is from a mosque, they are flexible. I wonder what is the application came from a church! How would they have reacted

Did you get the dates correct ? Notice by way of signage is sufficient but not sure on the period given for owners of neigbouring land to write in their objections !
Issue is notice board was blank from march 26 till recently was observed to be filled up after the closing date of tempoh bantahan
I am not sure of the correct dates but it may be that:
1. Commencement date for objection -27/7/2010
2. Closing date for objection – 17/8/2010
3. Approval date for application – 20/8/2010
Something is fishy if the approval date is on 20/7/2010 before the closing date for objection on 17/8/2010.
Dr rafick- The closing date is correct but notification of date to public was not made clear to surrounding residents. We suspect it was written after approval was given. Most of us only saw it in the last few days
My guess is that none officially objected since this is extension of the mosque project and in providing accomodation to the imams, bilals and siaks for the mosque.
Dr Rafick – Your guess is wrong. I objected as early as in March/April 2010. The residents mostly were waiting for information about the objection period before they raised their objections. A row of houses on the side of the mosque which uses a side entrance were not even aware that the signage is present as it was put at the main entrance which they dont need to use.
As one member of the mosque committee is a practising architect, they must know the approval process. I will give the benefit of doubt that MPAJ has done their work.
Dr Rafick- Because he knows the process and MPAJ flexibility because it is for the use of the mosque, I believe he and MPAJ internal people mastermind of the whole process. For record, he is insisting of building the quarters rather than buying whereas more than 20 units of Sinaran Ukay condo has been for auction since Jan 2010. I wrote to the mosque committee and ask them to buy as the price is cheap RM60K onwards for a minimum size of 1200sf. They dont want to but despite the condo is located 100m from the mosque.
MPAJ is duty bound to approve the plan unless there are valid objections before closing date for objection and the development would compromise safety standards. 20 ft away from slopes are perfectly OK. The submitting officer/engineer for the project must ensure that the slope is not disturb during construction and protection are implemented.
Dr Rafick- MPAJ broke their own rules. They are (a) Zoning 2008 (b) Garispanduan pembinaan rumah JPBD which highlights the requirements for side roads, reserve roads, utilities etc. On the basis of roads alone, the houses cannot be built (c) JPBD guideline on developemnet in hilly areas. There must be a buffer zone which should be 3x the height of the hill. That alone will justify why the project cannot be approved

I think you are aware that there is a defination of neighbouring lots (related to distance) that are entitled to object. I think the rows of houses on the side of the mosque and the row of end units including yours pass the defination.
Go for it , but make sure you have locus and sue MPAJ for breaking the rules.
