I do hope this letter finally reaches you through your political network one way or another. My aim is to highlight to you our frustration of the level of service (disservice) from you as an elected MP/ADUN. It is the same advice that I gave your predecessor Azman Wahid (UMNO-BN BA) a year before the 12th General Election. Azman Wahid was my school mate back in Ipoh. I bumped into him at Tesco Ampang several months after the 12th GE and he told me that he should have taken my letter to him seriously. I told him that it is too late now and no point thinking about it. He will never regain the trust of the people in BA.

The purpose of me writing to you is to remind you that we the people who elected you expect some service. Right now that is sorely missing. As ADUN of BA I expect you to play your part to raise important issues related to BA people in the Dewan or to the State Government. It is the same as for being the MP of Gombak.

I have been following you, Anwar and several others on twitter for several months now. The thing about technology is that if it is not properly used it can back fired against you. Trough out the time when I was following you, I could tell where you are exactly every time of the day and night. For e.g. this week when the Parliament was in session you were in Taiping with Khalid Samad. I had expected you to be in Parliament and address issues of relevance to the country.

What is probably most frustrating is that I sent you several SMS, an email and on twitter asking you to raised some questions relating to the usage of the power of the minister in protecting purchaser interest in Parliament. I did not get any respond from you. Is it so difficult? After all, I had given you a write up, a section of the relevant ACT and the necessary questions which have an important impact on the fate of abandon property owners in Malaysia. All you need to do is to find the opportunity to ask but did you? How can you ask a question when you are not even in Parliament when the Parliament is in session.

Please tell me whom have you seen or what have you done to help your constituents in resolving the abandon housing issues? Your own political party members in BA are the victims of the same project. Please tell me how many minutes of your time that you have spent to help the fate of 2000 property purchasers in Ulu Kelang.

Parliament question time is limited. Instead of making full use of it, half of the time has been taken by the “jumping beans” and now by Anwar on its APCO issues. You also use your time to defend Anwar on the APCO issue. What is so important about APCO that it needed to be raised in parliament?

Records will show that Anwar first brought up this issue. Please excuse me for saying this outright. So what if 1-Malaysia is copied by 1-Israel or 1-Antarabangsa or 1-Balakong? If through 1-Israel, it made Israel one of the strongest country in the Middle East then there is no harm if Najib wants to follow the same recipe? As long as we don’t end up behaving like Israelis we are fine.

Malaysians are neither blind nor stupid. Most of us can appreciate the between the slogan 1-Malaysia and the reality behind it but wasting parliament time by raising such issues is counter productive. It does not help anybody.

Saudara Azmin, I valued some leaders of PR like TSKI for his professionalism and hard work and YB Zuraidah who at least try to help me. It is my prayer that PR continue to rule Selangor for another 5 years but my worry is that people like you will bring the downfall of PR. My members are really upset with the poor progress of the Ukay Bistari project. What makes people angry is that both Anwar and you told us that you will help us but reality is nothing has been done.

I twittered Anwar on Sunday and asked him about his promises. He only replied to me after several reminders from me and another friend. He claims that he missed my twitter because he was busy preparing to answer question related with APCO! But fall short to address our question about his promises. That really frustrates me because he brought this irrelevant topic to Parliament and wasted the limited parliament session time. In reality APCO has no impact on Malaysian lives.
- Just because some of the office bearers are Jews, he wants to make a political mileage. It upsets me that you backed him up at the expense of people like us who wants you to ask relevant questions. Questions that will have an impact on the people whose property has been abandoned nationwide by the developers.
My advice to you is change or be prepared to be changed. Take my word for it.

Very few independent candidate can get elected unless they have national stature. If they have, they were probably part of the BN govt. Sharir Samad was one who got elected as independent. In Bukit Selambau history was created when an unknown independent, Arumugan defeated the BN candidate in straight fight when the PKR candidate was disqualified. This was only possible due to the anti-BN tsunami.
So like it or not, we need political parties to advance a political agenda. Independents usually lose their deposits. In the Bukit Selambau by-election, 13 independents took part hoping to repeat Arumugan’s feat. They all lost their deposit.

To be fair, I think Anwar has the interest of the nation at heart when he brought up the APCO issue. He has the right to ask what is Malaysia doing with an unsavoury outfit with Zionist elements and used by rogue regimes and war mongers. If these people get hold of sensitive national secrets will they use it against us one day, for eg., to force our vote at the U.N.? But look at how BN parliamentarians respond to him? Instead of looking seriously into his claims, they are taking action against him. We know who are better MPs here but I’m not excusing Azmin Ali for his lack of service.
The issue of abandoned housing is a pressing one and it will take a long time to solve as long as BN remains in power. Dr. raffick is taking the right path to form a pressure NGO to change laws. It may take a decade before you can see any effect. If we want to shortcut the process, change BN.

(3) I have many friends in the intelligence community and I can confirm with you that all this talk about security threat is garbage.
Let us judge a person by his role. He is an ADUN and an MP. What has he done in this capacity? I think PR should do a survey in BA and finds out what people feels about PR and Azmin. My own assessment is that there is a very strong support for PR and very little support for Azmin. Get some independent party to do a survey and we will know the truth.
YB Zuraida Kamaruddin has been shouldering most of his task in BA. This lady has more support of the people here than Azmin.

I have always maintained that it is DamaiBistari/Intelbest ( and the Promoter) obligation and responsibility to complete the project. That is why we are running in a circle as the law protects the developer. Prompting from the Federal and State Governments is going to the deaf ears of the developer .We have no choice but to push the Federal Government to amend the Act. For a start we are getting PR MPs to raise the matter in Parliament.
On the Malaysia-Indonesia relationship is like berbalah adik beradik. In the current globalised world it will be less of conquest/acquisations but mergers.

thank you DR for the very brave letter post! To be a good leader is someone who are ready to be lead! For me, APCO also is something that VERY IMPORTANT shud be revealed for the people to know, BUT in the same time, if evrybody is raising up the same issues and everybody is trying to protect on ONE HOLE, who are going to protect the other hole?
So, i think this is not the first time people complaining about YB Azmin, sumhow he shud take it seriuosly and make things better and clear. Serving the people are his priority!
Compare to UMNO BN, PR is more relevant to govern, because the people are SICKED with UBN. very much! sincerely, i don’t want because of PR MP’S who are not performed, we loose our vote for the next GE!

Give Azmin a break . You are barking at the wrong tree . You should go after Kementerian Perumahaan and try to revive UK Bistary thru SPNB . Why you are not doing this ? Azmin or PKR Or Selangor State not to be blamed , it’s Talam that screw this project . If you are sincere to make UK Bistary revived , SPNB is the right avenue . The govm formed SPNB for this . If we (Lembah Beringin Pro Term Comm ) can make SPNB to agree to revive our project , i see no reason for you to fail .
P/S Lembah beingin did not materilised bcos at the end we counld not get 70% consent for buyers .

I am with Dr Rafick in the PHUKB committee engaging with the developer, DamaiBistari, JPN/KPKT who are monitoring progress of the project and currently regulating the HDA account, the Task Force of the Selangor State Government who has brought in a PMC, RSS Consultancy to bring in rescue contractors to complete the project, the office of the Selangor Sate Economic Adviser who lately has taken interest in the project, Malaysian Trustees representing the bondholders who are interested in redemption of the loans. We have been around since mid 2007 and please do not question PHUKB sincerity in looking after the interest of the UkayBistari purchasers.
The UkayBistari project classified as “project sakit” comprises of Phase 2:
1. 100 units D/S terrace houses
2. 1027 units of service apartments/shopoffices
3. 60 units of PKS
4. 120 units of PKSR
5. 146 units of low cost flats
6. 253 units of low cost flats
The project was supposed to be handed over in mid 2006. It is now in delay to close to 4 years.
What have PHUKB done :
In mid 2007, we convinced 95% of the purchasers to agree to the court order S176. This allowed protection for the developer to complete the project without a winding up worries over their head . This was with the premises the developer promise to undertake completion of the project in stages , the last in Sept 2008. We negotiated with Malaysian Trustees not to wind up the developer when they failed to complete the project as promised in Sept 2008.
During the moratorium period we negotiated with SPAN and SYABAS to allow temporary water supply to be connected to the 100 units D/S terrace houses, which had actually been substantially completed way back in 2006. Hence, TCF was issued to this package and purchasers received their keys in May 2008.There was hardly any construction progress for the rest of the project.
In late 2008 we brought in the Selangor State Government through the Task Force headed by YB Saari Sungib to facilitate and put pressure on DamaiBistari to restart the project. RSS Consultancy was brought in to find rescue contractors to complete the uncompleted units.
At the same time we engaged with JPN/KPKT to also put pressure on DamaiBistari. To protect monies from balance of the purchase price, we got JPN/KPKT to regulate the HDA accounts. The developer was using collections from progress billings to pay more for their own administrative expenses rather than paying contractors. Only after a long battle did DamaiBistari eventually agreed to JPN/KPKT instruction in Sept 2009.
The modus operandi for payment to the rescue contractors are through progress billings from the balance of purchase price and partly through contra on unsold properties. This did not work as cash flow was the biggest issue. Contractors were not paid for work done and they just could not sustain completing the project using their own funds. The Promoter ( we suspect TSCAC ) to DamaiBistari had countless time promised to inject funds through sales of land and properties. These were empty promises as until now the deals have not materialised. We are pursuing this matter through both JPN/KPKT at Federal level and the Selangor State . We are leveraging on the good office of the MB as TSCAC/TALAM and MB Inc have some sort of a Settlement Agreement and because TSCAC through his nominees and proxies has a lot of land banks in Selangor.
RSS Consultancy have managed , though contractors have not been substantially and fully paid, to complete the 146 low cost flats. A big do was organised by PR in mid Feb with YB DSAI, YB Azmin, YB Iskandar, YB Zuraidah, YB Saari among others in attendance in the handing over of keys to purchasers. In the speech , PR made it their renewed agenda to rehabilitate abandoned housing in Selangor . Knowing that problem of abandon housing is more of the Federal matter, PHUKB requested PR MPs to bring up the matter in Parliament . The impression that I got (you can say a promise) is that it would be done.

I believe AK has given a good summary on what has been done. However a summary does not show the total man hours involved, the frustration we faced, the empty promises that was give and lack of will power by the state and federal government to solve the issue of abandon housing. The state while having the upper hand only wants to function as a mediator role. The Federal government despite having the laws on his side, dont want to use them.
For record, Anwar shook my hand and said “Dr, we will help.. dont worry” …. so far NOTHING… damn frustrating

One day when we have a robust 2 party system then politicians will be taken to task. Either they give good service or be booted out. Problem is, we now have an emerging 2 party system which is still a baby and it is under severe attack from BN.
Will the baby survive? This is by no means certain. BN is using every dirty trick it can to break up PR including, police, MACC, judiciary, royalty, seducing PAS, baiting PAS, bribing elected reps, sedition charges, illegal assembly, biting policeman, sodomy charge, etc.
We also seem to hold PR to a higher standard than BN. If an Umno MP never reply to your SMS will you shrug it off as ‘biasa’ or blast him in a blog?
Of course we expect more from PR than BN but let’s not whack the baby until it dies and then we only have BN in a 1 party system. You won’t like this dr. raffick, not at all.

What I did was trying to get Azmin to raised a specific question in parliament with the intention of locking Minister of Housing to use his power under the ACT 118. It frustrate me because he did not respond to my request via sms,call,email,tweeter. Luckily I had asked YB Zu to do the same as a backup plan and what need to be asked was finally asked yesterday at 12:37pm. I am now waiting to get the Hansard. In the end YB Zuraidah delivers.
So your questions was asked already…does it matter who ask the question…?

Why do you think so negatively. Let me put the record straight
(1) When the request was first sent to Azmin about 2-3 weeks ago, he did not respond. I chose Azmin because the UKB project is under the Gombak Parliament Constituency.
(2) Since he did respond, I had to prepare a back up plan where I ask YB Zu who is the MP for Ampang (and BA) where I live. YB Zu responded immediately
(3) Yb Azmin responded a few days ago after I sent two clear hints in my blog
(3) On the 1/4, YB Zu asked the question in parliament. Azmin sent me an email between 4-5 pm saying that he asked the question in parliament. The project is indeed in Ulu Klang and the ADUN is YB Shaari. The Abandon Project Task Force is is indeed headed by YB SS. The units that are involved in total is in excess of 1800 units. It consist of D/s Terrace, service apartments, low cost, medium cost, shops and office. The issues that I ask Azmin to raise in Parliament is pertinent to all nationwide abandon property owners. Azmin is the ADUN in my area and also the MP of Gombak where the project is located. He is the right person to raise the issues.
When we owned completed properties in Selangor, the state benefits from two aspect (1) Socio economic (2) Various land and quit rent tax .
The truth is that you dont like me raising my question against Azmin/PKR because you are too “taksub” with him and the party. You need to be objective.
The state and the federal government has the moral responsibility to solve abandon housing issues in Malaysia

Let’s stop the blaming game. PR politicians must do it differently. Just treat the rakyat as apolitical and provide opportunities to the deserving regardless whether they are BN or PR supporters or they are fence sitters. But oppotunities given must not be taken lightly and if found useless penalised them. The fear of wanting support from every Ali, Ah Chong and Muniandy and put to ransom by them is going to be PR’s downfall.

Saya di antara beribu orang yang telah ditipu oleh developer. Dah bertahun naik turun pejabat pemaju, pejabat peguam dan juga kementerian yang berkenaan. Dah beribu duit habis tak termasuk bayaran kepada bank.

My support goes to YB Zuraida. Very responsive, hardworking and people oriented. No matter how much she tried to cover for her colleague but YB Azmin has to deliver.
I absolutely agree with DrR’s message in this post. A MP or ADUN should pay equal attention if not more in airing the plights of his/her constituents and better still do something concrete about those plights. The average Joe Voter normally give more weight to issues that affect him on daily basis.
Politicking on the APCO issue need not be a parliamentary matter at this stage. If there are documents to prove APCO’s link to zionism, then Anwar, Azmin, and all the PR MPs and ADUNs in Malaysia should just lodge police reports and MACC to complaint of the Government’s complicity with the zionists. They can all do this on the way to Parliament and State Legislatures where they will then have time to raised issues that affects their constituents directly.
