Death at MACC: My CSI XV

21/10/2009 by drrafick

1. I completely forgot that today is the day that the Thai pathologist Dr Pornthip Rojanasunand (Dr PR) was supposed to take the stand at the TBH Inquest. I was busy attending a seminar and half way through, suddenly by blackberry receives strings of updates from friends and unknown people asking me to read the Malaysian online papers. All of them are now more than ever convinced that TBH was killed in the MACC premises.

2. Dr PR background as a no nonsense person with 10000 post mortem behind her certainly will create a dent in anyone theory that TBH jumped out of the window voluntarily. In my previous CSI series, I have indicated that there is just no motive for him to jump. There are more motives for him to continue living as he is getting married in the next few hours.

3. In her testimony she acknowledges that, Dr PR did not visit the site. She did not examined the body but she based her findings based on the post mortem reports, pictures provided by various parties and findings of her 2 assistants that came over a few months ago. Despite that she is confident enough to conclude that there is an 80% probability that TBH was murdered. Would it be 100% or 50% if Dr PR was on site after the body was found and if she were able to do the PM on the body of the late TBH? In the peoples mind, I believe many would believe that she would have concluded beyond certainty (i.e. 100%) that TBH was murdered.

4. What does this testimony means? To some it may means that TBH was murdered by MACC officers. To me it means a lot more. It means that the entire system which consists of the MACC, Police, the doctors (from Klang and UHKL), and officers in Putrajaya is now on trial.

5. It creates a damning perception among the people on whether the Government Machinery can be trusted to work professionally and independently. The perception is now growing that the interdepartmental cooperation has gone beyond the “professional level”. It appears now that there is a cooperation not to uncover the truth but to cover it up!

6. Based on the earlier court proceedings, there were unusual communication trend between MACC officers in Shah Alam and MACC HQ in Putrajaya while the death took place. This piece of clue and the other related testimonies by MACC officers suggest that they knew what was going on. For that reason, Hishamuddin (MACC No2) had told his staff not to lodge a police report. Despite he was in the office the whole night he was in Putrajaya subsequently and asked his officers to go to Putrajaya and brief him.

7. We must not forget the “surat layang” which gives information on the inner working of MACC and character of their officers and in particular Mr. Hishamuddin. The latest information by Dr PR, the various facts deduced during the inquest and the surat laying must be evaluated as one.

8. I believe Dr PR has strengthened my own theory and deductions that TBH was either dead or unconscious when he exited the window. It seems both of us agreed on the estimated time of death. I am waiting for her to comments on the torn pants as well as with regards to the damage shoe.  It points to the fact that he died while he was in custody of MACC. He was never released.

9. This is a very sad day indeed. The public is now more that certain that TBH was murdered in the process of bringing down the Selangor State Government and not merely investigating a corruption. The way he was investigated is certainly different from the way other people like (e.g. Khir Toyo) was investigated. If I am not mistaken, Khir Toyo did not spend a night at MACC. It will further enhance the people believes that there are politicians involves in this whole scheme.

10. Personally, I say it is the best interest of BN government to give up the culprits, punish those who are involved as this will have a long term implications. BN need to sacrifice those people to protect the interest of the political party. Right now managing people perception is far more important than anything else. I suggest they do it before it is too late. To the doctors of Klang Hospital (and UHKL) that were involved in the Post Mortem, they must be pacing in their office…

We all know it’s a homicide. Eventually Dr PR will only tell us that it’s a homicide with her supporting evidences. Sadly to say, no culprit will be caught because there’s more than enough time for them to clean up the mess, with the help of our local pathologists trying their very best to fool the people.

I just hope the truth will make known to all Malaysia!.

I believe the whole thing is just a plot. I don’t think death due to fall or causes other than fall is so hard to differentiate for the forensic experts. They are just buying time. By the time the case is proven to be a homicide, all the evidences pointing to the culprits should have been destroyed.

      Dear Layman,

Yeah, a plot. Part of the GRAND scheme that’s being unraveled.

Wait for tomorrow’s Perak State Assembly sitting to understand PART of the GRAND Scheme.

So far, statements made those Federal authorities (Home Minister, Police,State Secretary, etc) indicated a clamp-down via heavy-handed tactics.

Hope someone can provide live feedback from the ground tomorrow.

I think you should write to a reknown University…., and seek heir approval on forwarding a Thesis.

A thesis on ” One Malaysia and The Roles of All The Departments Mention Above including Their Respective Heads.”

Bravo…CSI…., you might be a PHD holder by year end. Then we have to address you as DR. CSI

God is great and justice will prevail. That’s all I can say. I don’t want to be a wreck living in my own country.

      Stateside,

Sad to say….., but most of the time God avoids doing overtime. That’s when he sees most of the fun.

  8. on 22/10/2009 at 6:54 PM eekay

This is already so expected. Even without Dr Porntip’s finding, any Tom, Dick or Harry with a sane and intelligent mind would have guessed he did not commit suicide. MACC fools are the only ones in denial.

Stupid and foolish theories they came up like saying TBH is mentally not sane, he’s having affair, he’s penniless to get married, etc, etc, that’s why he commited suicide.

I hope a deserved justice will be given to the late TBH for him to rest in peace.

      eekay,

Sad to say we are always looked upon as Idiots. Only time will tell how the rakyaat will react when it dawns on them like the shepherd calling wolf.

  9. on 22/10/2009 at 3:34 PM lorenzo

As usual, all deaths in police or MACC custody or any that involves rich and powerful people and politicians will be classified as “sudden death”. What that means we do not know. But we do know that investigation will be stopped. ISA will be invoked to threaten those who ask too many questions.

Of course, the authority can bet on the fact that Malaysians have short memory, and they will eventually forget everything that has ever happened. Or maybe they expect us to pretend nothing has happened and we all go home to bask in the glory of “Bolehland”.

  10. on 22/10/2009 at 3:34 PM donplaypuks

Interestingly, in the inquest into the “death by paraquat” case of local actress Sujatha, a platonic friend and employee of Paari Vell, Samy Velu’s son, certain doctors in Klang lost crucial blood, fluid and tissue samples.

More than that the haed of the GH failed to give intructions for an autopsy to be carried out although he was legally bound to do so and the Police had actually handed him the necessary legal forms to carry out a mandatory autopsy!

Is there something in the air in Klang, a bit of salt perhaps, that affects the brains of doctors there?

The result of the Lingam RCI is now out. As expected, the AG has ruled that there is no case against Lingam. This despite the findings of the RCI that shows otherwise.

This Teoh’s case, just a judicial review with such a limited scope and lowly court slaves will not even see the light of day. A waste of government resources, money that can be better used to clean up our drains during the current rains.

The situation has sunk from hopeless to plain old stupid. It is no use getting angry anymore.

      azhar,

Two plus two might not always add up to four in Malaysia. If you know what I mean…., just pray that God will go on overdrive…., if he is not working overtime.

With this latest incriminating findings by Dr PR, the cry for justice for TBH will be revived and renewed. But ‘hold your horses’ rakyat, from track record of this Beend govt. when it comes to the crunch whereby they can’t cover their asses anymore and all other tactics failed they will use their final trump card .. sacrifice a few ikan bilis to take the wrap. However all good things must come to an end, and God willing and with his divine intervention, we hope that his will be the beginning of their END.

The brutality and murderous mindset of the MACC and their collaborators should rank them among the likes of Idi Amin, Hitler and his Gestapo, and the formidable CIA.

  14. on 22/10/2009 at 2:47 PM Anak Malaysia

The culprits involved should own up.These murderers will not sleep peacefully at night. The soul of TBH will haunt them untill they go to Hell.May god bless the soul of TBH,and the Almighty will expedite these muderers to HELL.

  15. on 22/10/2009 at 1:34 PM KB

Malaysia now leads the world in brutal interrogation techniques. Now they have anal penetration as a new interrogation technique. Bravo, MACC! The Nazi Gestapos would have been proud of you if they are still around. Zimbabwe, watch and learn!

  16. on 22/10/2009 at 1:13 PM Kadazano

It is generally believe that MACC has not reached a violent state as those in some of the Latin American countries. Nonetheless the mostly likely cause of death is the linear cracks on the head caused by some blunt object, slander and long perhaps. We were told cracks on the head due to impact on the concrete floor from a height will be wide spread around point of impact as the floor is flat. This appeals to common sense. If we think more carefully the following might have been the scenarios.
The interrogators, in order to meet the tight time table to get a confession, became impatient and resorted to more extreme tactic of intimidation which had unfortunately gone wrong. Purposely causing the death of Teoh so soon after Kugan’s case is not very likely and similarly to push some hard object through his anus which might leave a wound for Teoh to lodge a complaint later is also not a thing to do in the present atmosphere. I believe we were being told that the tear in the rectum not the result from cuts due to bone framents. What could have caused this wound then one may ask?
My postulation is – immediately after his death, they dragged or carried him to the toilet and push him through the window to paint a picture of suicide. This was done soon after his death for the pathologist to arrive at the fact that he was still alive at the time of impact. This will give the signature of him being alive at the time of impact does it not . One person brought the body up to the window perhaps standing on one chair. To get Teoh head out of the window he has to hold him by his neck and push his head down. Dead man ’s weight is heavy and these other guys holding his body from the floor may not be able to push his body high enough to scale the window, they took whatever was near to him, perhaps a broom or a mop being the likely item found in the toilet. The hard slander stick might have made its way into the anus, the flip of the body dislodged the stick violently from the anus causing the tear. The pants must have stopped it from entering the anus any deeper otherwise it would have gone the full length of the rectum. We should be able to find further evidence on his pants and underwear if this is the case.
All finger prints were wiped clean off the window or it was not touched at all in this situation. Try to climb the widow in your toilet and see if you can avoid leaving any finger prints unless you wear groves or purposely avoid making any print marks. If Teoh who climbed the window to commit suicide his finger prints should have been left on the window. When there is no finger prints on the window it means someone else is helping him to scale the window.
How about his watch ? His watch must have fell off his wrist during the manoeuvring in the toilet or before that. It is not normal for a person helping MACC as a witness ( not a suspect) to surrender his watch to the MACC office.
The Malaysian pathologists observed all the tell tale signs but were directed to make inference to arrive at a verdict of probable suicide. So glaring are the signs, pathologists with the most basic training would have picked them up but purposely chosen to ignore them. They went against their conscience to fool the public with their devious reports shrouded with fancy medical jargons.

Pls protect Dr. Porntip in this animal country…not to be the next “Bala”.

  18. on 22/10/2009 at 12:31 PM rocky

    dr,

we know this, that the whole system is corrupt and is there to please UMNO/BN.they will bend laws or break them and ignore the constitution all for the leaders of UMNO/BN and their cronies. and we the people do not believe the govt and yet the govt is surprised why people do not trust them or the papers. The govt has no credibility. same as the police, MACC. They are all tools to protect the UMNO/BN and not the laws of the country.

we trust people who are outside the system like Khunying Dr.PR and blogs etc.

only a change in govt can change the system. for all the bad things in Selangor, we know there are more good things. Corruption is less and there is more accountability. Just check how many lawatan sambil belajar now in selangor. look at penang too. The only way forward is change cos UMNO/Bn will not change. and the new guys will change it cos they need to show they are different and will work for the rakyat.Ketuanan Rakyat needs to be supreme.

we the people should go for at least 2 party system and use our powers to change when we require cos than these people will be working for us knowing their job is online. a govt that is long in power gets arrogant, corrupt and only work for their own benefit.

the nation can be saved and we need to save it for our future generations!

    • on 23/10/2009 at 1:44 AM balasi

      Rocky,

I agree with you, but these new guys in the block in Penang and Selangor……, have their weakness too. Sometimes it just dawns upon me that both are irrelevant. Just throw the dice and hope for the best.

  19. on 22/10/2009 at 12:25 PM sapu

It is indeed a shame that a homicide has been committed in MACC office and that there was a conspiracy to cover up as well. When the very agencies that had been set up to protect the public in turn has been used by the govt for its own personal interests, what hope is there for the people of Malaysia in spite of all these slogans about 1Malaysia, People First. Isn’t there anyone in the service with a clear conscience to do what is right? Are all these people corrupted mentally to the core, to the extent of covering up a murder. Let us clasp our hands together and pray for the soul of the late Teoh, and at the same time pray that all those involved, be they directly or indirectly, face the ultimate justic on their deathbed when they shall meet and answer to their maker. Remember, what goes around, comes around. May Hishamuddin and the pathologists have sleepless nights for their crimes and may they burn in hell for all eternity.

    • on 23/10/2009 at 1:54 AM balasi

      sapu,

Jumping to a conclusion should not be the order of the day, we should all hope that the Coroner…., decides that a second postmortem be carried out by Dr. Porntip.

Since she had said that four months is not late enough to still come out with substantial evidence…., she should be given the go ahead, with the blessing of TBH’s family.

Let the death do the talking.

    • on 23/10/2009 at 12:06 PM Morning Dew

Murder is bad but what is even more disconcerting is the torture that TeohBH had to endure and it would seemed that such torture is routine from what Gorbind had presented in court.

  20. on 22/10/2009 at 12:16 PM Morning Dew

Dr.PR did not make general statements and conclusions but supported her remarks with very good and specific observations. For example she mentioned the split in the skull was due to a blow by a heavy object and not due to the fall. She said that if it was from a fall it would be circular but this is linear. This was the distinguishing mark.

The anal tear was 6cm x 2cm and this could not be due to the bone fragment puncturing the anus due to the fall but could only be due to an external object. This means TeohBH was tortured.

A strangle hold could have been used to make TeohBH unconscious before he was thrown out of the window.

The lashing marks on the thighs also pointed to torture.

  21. on 22/10/2009 at 10:27 AM aiyohteruknye

While Malaysians already knew that this whole thing is a big cover up (yet bloody again!), Dr Pornthip’s findings only serves to confirm our suspicions.
The world watches what amazing things can happen in our courts.
The world watches HOW amazingly incredible the malaysian govt will somehow wrangle themselves out of this mess.
End of the day, we suffer, truth is hidden, truth is bent, injustice wins the day in yet another day-in-the-life of the Malaysian public!
May the wrath of God be upon all those guilty!

    • on 23/10/2009 at 2:01 AM balasi

      aiyohteruknye,

Repeat that again …and let all of us cheers to it. You are seeking a reply….., I don’t think Dr. Rafick..can reply, for you have voiced it and also concluded on it.., what to reply.

  22. on 22/10/2009 at 10:24 AM Bob

It is unfortunate that Dr PR involvement little too late. Most of the evidence would have been erased. TBH’s shouldnt have rushed thru the funeral if they wanted to see justice.

Anyway, better be late than never.

  23. on 22/10/2009 at 9:53 AM KhirJ

What if they eventually conclude is a homicide case. Will there be enough evidence to catch the culpritS?
In the end, no one was blamed , no one was sentenced…everything is based on PLOT.

    • on 23/10/2009 at 2:04 AM balasi

      KhirJ,

Food for thought….., but it will basically be like my neighbours dog chasing around it’s own tail.
