1. There is a remote possibility that what I about to write would would ever make it on Malaysia Today website. The title may be catchy and many would have presumed that it is about Anwar or Althantuya or some laws with regards to Police brutality. I must say I am about to disappoint most readers. There is more to the problems of the people than the political issue in this country.
2. Officially in the records of the Housing Ministry about 142 housing projects are considered as abandoned. Unfortunately, the Ministry has been classifying projects with classes and sub classes that have brought the numbers down to 142 projects.
3. In reality there are more than 500 projects in Malaysia that is abandoned, delayed or problematic. The common feature in all cases is that purchasers paid their dues on time but do not get their house. The total value of these projects runs into Billions of Ringgit. The purchasers are not the source of the problem. The developer who has poor financial and project management is the root cause of the problem.
4. I and some friends banded together to help 1800 purchasers in a project called Ukay Bistari past one year via an organization named PHUKB. It has not been easy going. The difficulty lies with the fact that moving those people with power is like moving a mountain. It does not help either that we have to learn to manage this issue with a steep learning curve with limited guidance.
5. In the course of our effort we stumbled upon ACT 118 which is the housing Development. We also discovered that there is actually a Section where the Minister has the power to protect the interest of house buyers. I am referring to Section V, Article 11 in the said ACT.
6. The ACT basically says that the Minister can take proactive action to protect the interest of the house buyers. My research shows that the Minister has never taken any proactive move to utilize this ACT in the interest of purchasers. What is even worse is that many purchasers are not even aware of this ACT and they have not push for the minister to use it.
7. Since the discovery of the ACT, we have been actively pushing the JPN trying to get the Minister to invoke the relevant article. Like what I have said earlier, it is like moving a mountain. People in power always ask what our locus in this matter is.
8. As a purchaser who had collectively has paid RM 150 million to the developer with remaining RM 50 million to be released soon, we certainly has plenty of locus. The money is ours and the incomplete building is partially ours. The developer has abuse our money (RM 150 million) thus far and I am not about to let them abuse the remainder.
9. As long as I am alive, I will make sure that they will not continue to manipulate and continue making life difficult for 2000 people. For those who remember how I had confronted Zain, the JKR minister, over the landslide issues, they can expect the equal amount of tenacity from me to resolve this issue. Tan Sri Chan Ah Chye, you can take my word for it.

Pada 6 bulan kebelakangan ini, Saham Talam Corp di BURSA Malaysia selau berada Top 10 kaunter paling aktif dan hari ini No 3 paling aktif diniagakan. Sudah pasti Se Tan Sri itu ada planning dalam kepala dia, mungkin dia hendak naikkan value share dia supaya dia boleh jual dan keluar dari Talam.
Since Setan nie sudah buat ramai orang sengsara, mengapa tidak kita pula buatkan dia sengsara, sabotage dia dan Talam dengan kumpulkan pembeli yg teranaiya dan buat demotrasi. benda yg havoc pasti membawa pemberita datang, bila berita keluar, investor pasti lari daripada membeli saham Talam.
Ini juga boleh beri peringantan kepada developer besar yg lain bahawa pembeli juga boleh bertindak cara lain walaupun undang2 tidak memihak kepada pembeli.

I guess Talam had the most failed project as developer and I wonder why the DBKL stilol allocate land for Talam to developed.
I have a house developed by Talam and got a “Temporary CF” on 2nd year and that’s it.
Anyone goes against Talam got my signature….

I was involved with Lembah Beingin project before . We fight for 7 years , at the end we give up afetr SPNB agree to revive the project . The easy way to settle your issue is to meet with SPNB . Rest assure that SPNB will complete the project . The only catch is to make sure 70% buyers are agreeable for SPNB to take over .
With SPNB taking over , buyer are not charged any extra payment other than stated in S&P .
Just forget about LAD from developer , becouse SPNB will not pay any LAD to buyers .
Once the completion of the house is pass to SPNB , go after Developer .
At the end the house will be build , whatever come form developer consider it as a “bonus” .
No MP , minister are in favour of rakyat . Seat down with the 1800 buyer of Ukay Bistary .

Thus under the Law, you are allowed to form an adhoc committee and have The Locus.
If you are unable to “move the mountain” then an action should be filed into Court under this concept.
As you have 2000 buyers affected, & if you levy RM100/- per buyer as fees, then you would have RM100 x 2000 = RM200,000/- !!!!!!!!!
Pls further understand that when you file in as Representative, costs & damages CANNOT be placed against you.

The irony of it all is that the Ministry , financiers and lawyers look at developers as carrying the bigger risk and so need all the protection.
It is always the case that people in powers will help their kind. Rakyat take the back seat !
